General Terms and Conditions

These General Terms and Conditions ("Terms"), together with our Privacy Policy, govern your access to and use of the TourVigator platform, including our website and any mobile applications we operate (collectively, the "Platform"). By accessing or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Platform.

These Terms have been drafted in English. Any translation provided is for convenience only. In the event of any inconsistency between the English version and a translated version, the English version shall take precedence.

1. About TourVigator

TourVigator is an online marketplace for tours, activities, and travel experiences, with its registered office in Zanzibar, Tanzania. References to "TourVigator," "we," "us," or "our" in these Terms refer to TourVigator, its officers, directors, employees, agents, affiliates, and distribution partners (collectively, the "TourVigator Parties").

We operate the Platform as an intermediary. Activity providers and resellers ("Suppliers") list and offer their tours, tickets, experiences, and other travel activities ("Activities") through the Platform. We act as a commercial agent on behalf of Suppliers β€” we facilitate the booking and collect payment, but we do not ourselves provide the Activities. The contract for each Activity is between you and the Supplier directly.

TourVigator and the TourVigator Parties are not responsible or liable for the actions, omissions, errors, negligence, or misconduct of Suppliers, nor for any injury, death, loss, or damage arising from or in connection with any Activity. Each Supplier is solely responsible for the accuracy of their listing content and for delivering their Activity as described.

2. Scope of these Terms

2.1. These Terms apply to all visitors, registered users, and customers ("Users") and govern all use of the Platform. By using any part of the Platform, you agree to comply with these Terms in full.

2.2. Where more specific terms apply to a particular service or promotion, those terms will be communicated to you. In the event of conflict, the more specific terms take precedence over these Terms. Any third-party terms that conflict with these Terms do not apply unless we have expressly agreed to them in writing.

2.3. These Terms apply to Users worldwide. The governing law and jurisdiction for all Users is set out in Section 17 of these Terms.

3. Our role as a marketplace

3.1. When you book an Activity through the Platform, the resulting contract ("Service Agreement") is formed directly and exclusively between you and the Supplier. You are purchasing from the Supplier, not from TourVigator. We conclude that transaction on the Supplier's behalf as their authorised commercial agent, and we collect payment from you on their behalf.

3.2. We receive a commission from the Supplier for facilitating the booking. The price shown on the Platform ("Posted Price") or the amount you pay at checkout ("Booking Price") includes our commission, which is funded by the Supplier and does not result in any additional charge to you beyond the stated price.

3.3. We may rank and display Activities using factors such as popularity, traveler ratings, Supplier performance, and relevance. No specific ranking or placement is guaranteed to any Supplier.

3.4. We may introduce verification, identity, or payment checks where we consider it necessary. If we have reasonable grounds to suspect fraud, a violation of these Terms, or misuse of the Platform, we reserve the right to suspend, restrict, or cancel bookings and accounts.

3.5. We are not obligated to maintain, update, or continue operating the Platform or any feature of it. We may modify or discontinue services at any time with reasonable notice. Any existing confirmed Service Agreements will not be affected.

4. Using the Platform

4.1. The Platform is provided for your personal, non-commercial use. You may not resell, commercially exploit, or use the Platform for any purpose other than browsing, researching, and booking Activities for personal use.

4.2. You may not use automated tools, bots, scrapers, crawlers, or similar methods to access, extract, index, or copy any content from the Platform without our prior written consent.

4.3. To access certain features you may need to create an account. To register you must provide your full name and a valid email address, and set a secure password β€” or sign in via a supported third-party account. You must be at least 18 years old to create an account and make bookings.

4.4. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately if you suspect any unauthorised access or use of your account.

4.5. You may only hold one account at a time. Accounts are personal and may not be transferred to another person.

5. Mobile applications

Where we make mobile applications ("Apps") available, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to download and use the App solely for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or reverse-engineer the Apps. We may release updates from time to time; continued use of the App constitutes acceptance of any updates. Use of the Apps is also subject to our Privacy Policy.

6. Customer support

As the commercial agent for Suppliers, TourVigator is your primary point of contact for booking-related queries, complaints, and assistance. You can reach us through our contact page or the details provided on your booking confirmation. In the event of an emergency on the day of your Activity, please use the Supplier contact details provided on your voucher or ticket.

7. Best price commitment

If you find the identical Activity you booked through TourVigator available at a lower publicly listed price on another website, under the same conditions (same date, Supplier, and inclusions), we may at our discretion refund the difference upon receipt of verifiable proof. This commitment does not apply to prices available only through loyalty schemes, private memberships, group rates, or promotions not publicly accessible. We reserve the right to decline claims where abuse or fraud is suspected.

8. Payment

8.1. The Booking Price is the total amount payable by you for the Activity, inclusive of any applicable taxes and fees unless otherwise stated. Payment is due at the time of booking unless a "reserve now, pay later" option is offered, in which case the specific payment terms will be clearly displayed at checkout.

8.2. We collect payment in the name of and on behalf of the Supplier. Once your payment has been successfully processed by us, your payment obligation to the Supplier is fulfilled.

8.3. Where transactions are processed in a currency other than your local currency, conversion rates and any applicable exchange fees will be displayed during the checkout process. Your bank or card issuer may apply additional charges; these are outside our control.

8.4. You must provide accurate and up-to-date payment information. The available payment methods are displayed during the booking process. By submitting payment, you confirm that you are authorised to use the payment method provided.

8.5. For refund requests that fall outside the standard cancellation policy, please contact us directly through our contact page.

9. Gift cards and platform credits

Where TourVigator offers gift cards or platform credits, they may only be redeemed against bookings made on the Platform. Gift cards and credits may carry an expiry date as stated at the time of purchase or issue. Unless required by applicable law, no cash equivalent will be paid out. We reserve the right to cancel gift cards or credits if we have reasonable grounds to suspect fraud or misuse.

10. Cancellations, changes, and refunds

10.1. Cancellation and amendment rights are governed by the conditions stated on the individual Activity listing and the Supplier's own terms. You are responsible for reviewing these conditions before completing your booking.

10.2. All cancellation and amendment requests must be submitted through the Platform or via our contact page. The time at which we receive your request determines whether any cancellation conditions apply.

10.3. Unless different conditions are displayed on the Activity listing, the following default policy applies:

(a) Cancellations made more than 24 hours before the scheduled start of the Activity: a full refund of the Booking Price will be issued.
(b) Cancellations made within 24 hours of the scheduled start, or failure to show up: no refund will be issued.

10.4. If a Supplier cancels your Activity, you will receive a full refund of the Booking Price. We will notify you by email as promptly as possible on behalf of the Supplier.

10.5. Refunds will be returned to your original payment method. In certain circumstances, and at our discretion, we may offer a platform credit or voucher as an alternative.

11. Reviews and user-generated content

11.1. Reviews and other content posted by users ("User Content") represent the personal opinions of individual users at a particular point in time. TourVigator does not verify or endorse User Content and is not responsible for it.

11.2. You are solely responsible for any User Content you submit. User Content must be truthful, based on your own genuine experience, and must not: be misleading or defamatory; infringe the intellectual property or privacy rights of any third party; contain promotional material for third-party businesses; or violate any applicable law or regulation.

11.3. By submitting User Content, you grant TourVigator a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, translate, publish, and distribute that content on the Platform, through distribution partners, and in our marketing materials. You retain ownership of your content.

11.4. We reserve the right to remove or decline to publish any User Content at our discretion, including content that violates these Terms or applicable law. We are under no obligation to retain copies of removed content.

12. Data protection and privacy

TourVigator collects and processes personal data in accordance with applicable Tanzanian law and, where relevant, other applicable data protection regulations. Full details of how we collect, use, store, and protect your personal data, as well as your rights, are set out in our Privacy Policy, which forms part of these Terms.

13. Intellectual property

All content on the Platform β€” including the TourVigator name, logo, design, text, graphics, software, and data β€” is owned by or licensed to TourVigator and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use any part of the Platform's content for commercial purposes without our prior written permission.

14. Assignment

You may not transfer, assign, or sub-licence any of your rights or obligations under these Terms to any third party without our prior written consent. We may assign our rights and obligations under these Terms to an affiliate, successor entity, or as part of a business transfer, provided that your rights under these Terms are not materially diminished as a result.

15. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or removed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.

16. Account termination

You may request the closure of your account at any time by contacting us via our contact page. We may suspend or terminate your account or access to the Platform at any time with reasonable notice. We may terminate without notice where there is a serious breach of these Terms, fraudulent activity, or where required by law. Termination does not affect any confirmed Service Agreements already in place at the time of termination.

17. Governing law and jurisdiction

17.1. These Terms, and any dispute or claim arising out of or in connection with them or your use of the Platform, are governed by and construed in accordance with the laws of the United Republic of Tanzania.

17.2. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Zanzibar, Tanzania, except where mandatory local consumer protection law in your country of residence requires disputes to be heard by a court in your jurisdiction. In such cases, we will honour those mandatory rights.

17.3. Before initiating any formal legal proceedings, we encourage you to contact us directly through our contact page so that we can attempt to resolve the matter informally and promptly.

17.4. The contract between you and TourVigator is formed in Zanzibar, Tanzania. The UN Convention on Contracts for the International Sale of Goods does not apply to these Terms.

18. Your Service Agreement with the Supplier

18.1 Formation. When you complete a booking on the Platform, you enter into a binding Service Agreement directly with the Supplier. We act as the Supplier's commercial agent and send you a booking confirmation on their behalf. The Service Agreement is formed at the point you receive that confirmation and consists of the Activity description, these Terms, and any additional Supplier-specific terms disclosed at the time of booking.

18.2 Pricing. Prices displayed on the Platform are inclusive of applicable taxes and fees unless explicitly stated otherwise. Suppliers are responsible for the accuracy of their pricing. Please review the Activity page and any Supplier-specific terms carefully before completing your booking.

18.3 Your responsibilities. You are responsible for arriving at the correct meeting point at the scheduled time, as communicated in your booking confirmation or by the Supplier. You are also responsible for ensuring you hold any required travel documents (including a valid passport and visa where applicable), meeting any health or fitness requirements stated for the Activity, and complying with all applicable entry requirements. The Booking Price does not include travel insurance; we strongly recommend that you obtain appropriate coverage before travelling.

18.4 Supplier rights. A Supplier may cancel an Activity due to circumstances beyond their control, including but not limited to adverse weather, natural events, or government restrictions. In such cases, a full refund of the Booking Price will be issued. A Supplier may also exclude a participant who does not meet stated participation requirements, poses a risk to the safety of others, or behaves in a disruptive or dangerous manner; in such cases, no refund will be due. Suppliers may make minor operational changes (such as adjusting a meeting point within a reasonable distance) and will communicate such changes where possible.

19. Final provisions

19.1. We may engage affiliates, agents, or third-party service providers to assist in fulfilling our obligations under these Terms.

19.2. We may update these Terms from time to time for legal, operational, or commercial reasons. Where changes are material, we will notify you in advance by email or via a prominent notice on the Platform. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Terms. If you do not accept the changes, you may close your account before the effective date.

19.3. Any formal notices under these Terms must be submitted in writing, including by email to the contact address in our Legal Notice.

19.4. These Terms, together with our Privacy Policy and any Supplier-specific terms accepted at booking, constitute the entire agreement between you and TourVigator in respect of your use of the Platform.

Appendix A β€” International Users

Applicable to all users accessing the Platform from outside Tanzania.

A1. Scope. This Appendix applies to all Users accessing the Platform from countries other than Tanzania. Where mandatory consumer protection laws in your country of residence provide you with rights that cannot be excluded or limited by contract, nothing in these Terms is intended to restrict those rights.

A2. Limitation of liability. To the fullest extent permitted by applicable law, TourVigator and the TourVigator Parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any Activity, including but not limited to loss of revenue, loss of data, or loss of enjoyment. Our total aggregate liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total Booking Price paid by you for the Activity directly giving rise to the claim. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

A3. Indemnification. You agree to indemnify and hold harmless TourVigator and the TourVigator Parties from and against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from: your breach of these Terms; your misuse of the Platform; your violation of any applicable law; or your infringement of the rights of any third party.

A4. Dispute resolution. We encourage you to contact us in the first instance to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be referred to the competent courts of Zanzibar, Tanzania, subject to any mandatory rights you may hold under the consumer protection laws of your country of residence.

A5. Consumer rights. If you are a consumer, you may have statutory rights under the laws of your country of residence that apply regardless of the governing law stated in these Terms. These Terms do not affect those statutory rights. Where a right of withdrawal or cooling-off period applies under your local law, please note that such rights may not apply to bookings for Activities with a specific date or time of performance, as these are typically excluded from standard withdrawal rights under most consumer protection regimes.
