These General Terms and Conditions ("Terms"), together with our Privacy Policy , govern your access to and use of the TourVigator platform, including our website, mobile applications, and related digital services (collectively, the "Platform").
By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.
These Terms are intended to apply to users internationally. Certain mandatory consumer protection, privacy, payment, accessibility, or other legal rights may apply to you depending on the country in which you reside or access the Platform. Nothing in these Terms is intended to exclude or restrict rights that cannot lawfully be excluded or restricted under applicable law.
These Terms have been drafted in English. Any translation provided is for convenience only. In the event of any inconsistency between the English version and a translated version, the English version shall take precedence to the extent permitted by applicable law.
TourVigator is an online marketplace for tours, activities, excursions, attractions, and travel experiences. The company is registered and operates from Zanzibar, Tanzania, East Africa.
The Platform connects travelers with independent activity providers, tour operators, guides, attractions, and other travel businesses ("Suppliers") operating in destinations in Tanzania and other countries around the world.
TourVigator is a marketplace intermediary. We provide the technology and services that allow Suppliers to publish Activities, travelers to discover and compare Activities, and customers to make bookings and payments through the Platform.
Unless expressly stated otherwise for a particular service, TourVigator does not itself provide, operate, guide, own, manage, transport, or control the Activities listed by Suppliers.
Suppliers are independent businesses and are responsible for the Activities they list and provide. The relationship between a customer and a Supplier may be governed by the Activity listing, Supplier-specific terms, booking conditions, and applicable local laws.
2.1. These Terms apply to visitors, registered users, customers, and other persons accessing or using the Platform ("Users").
2.2. Where additional terms apply to a particular Activity, promotion, payment method, service, or feature, those terms will be presented to you where applicable and may supplement these Terms.
2.3. If a specific Activity or service has terms that conflict with these Terms, the specific terms will apply to that Activity or service to the extent of the conflict.
2.4. These Terms are intended for Users worldwide. Mandatory rights granted to consumers under the laws of their country of residence remain unaffected where those rights cannot lawfully be waived.
3.1. TourVigator operates a technology marketplace that enables independent Suppliers to list and sell Activities to travelers.
3.2. When you book an Activity through the Platform, the Activity is provided by the Supplier identified in your booking confirmation, unless the booking expressly states otherwise.
3.3. Depending on the applicable commercial arrangement, payment and booking services may be provided by TourVigator as an intermediary, agent, payment facilitator, or other authorised service provider acting on behalf of or in connection with the Supplier.
3.4. TourVigator may receive a commission, service fee, distribution fee, or other commercial compensation from Suppliers or other parties for operating and facilitating the marketplace. Any amount payable by you will be disclosed during the booking process where applicable.
3.5. Activities may be ranked or displayed using factors such as relevance, destination, availability, popularity, traveler ratings, Supplier performance, booking history, commercial arrangements, and other operational considerations.
3.6. No Supplier is guaranteed a particular ranking, position, level of visibility, or continued listing on the Platform.
3.7. We may perform identity, business, document, payment, security, fraud-prevention, or other verification checks. Verification does not constitute a guarantee or certification that a Supplier or Activity is suitable for a particular customer.
3.8. We may suspend, restrict, remove, or cancel accounts, listings, or bookings where we reasonably believe there has been fraud, abuse, a security risk, a breach of these Terms, unlawful activity, or another legitimate operational or legal reason.
4.1. Unless expressly authorised otherwise, the Platform is provided for personal and lawful use. You may browse, research, compare, and book Activities for legitimate travel purposes.
4.2. You may not use automated tools, bots, scrapers, crawlers, or similar technologies to access, extract, reproduce, index, or copy Platform content without our prior written permission.
4.3. Where an account is required, you must provide accurate and up-to-date information and maintain the confidentiality of your account credentials.
4.4. You must be at least 18 years old to create an account or make a booking unless applicable law permits otherwise and the relevant booking process expressly provides for it.
4.5. You are responsible for all activity carried out through your account and must notify us promptly if you suspect unauthorised access.
4.6. Accounts are personal and may not be sold, transferred, or assigned to another person without our written approval.
Where we make mobile applications ("Apps") available, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to download and use the App for lawful personal use in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or otherwise misuse the Apps except where such activity cannot legally be restricted.
We may release updates, improvements, security patches, or new versions from time to time. Continued use of the App after an update may require acceptance of revised technical or service terms.
TourVigator provides customer support for matters relating to bookings made through the Platform. You may contact us through our contact page or the contact information provided with your booking.
For urgent matters occurring during an Activity, including operational or safety issues, you should also use the Supplier's emergency or contact information provided in your booking confirmation, voucher, or ticket where available.
Activity prices are determined by Suppliers unless expressly stated otherwise. Prices displayed on the Platform may vary depending on destination, date, availability, group size, currency, inclusions, promotions, taxes, fees, and other applicable conditions.
The total amount payable by you will be shown during the booking process before you confirm payment, subject to any changes permitted by the applicable booking terms or law.
Where taxes, government charges, booking fees, service charges, or other mandatory costs apply, these may be included in the displayed price or separately identified during checkout.
8.1. The Booking Price is the amount payable for the Activity as shown during checkout, subject to the applicable booking terms.
8.2. Payments may be processed by TourVigator or by third-party payment service providers, payment processors, banks, card networks, mobile-money providers, or other authorised payment partners.
8.3. By submitting a payment, you confirm that you are authorised to use the selected payment method and that the payment information you provide is accurate.
8.4. Where a transaction is processed in a currency different from your account or payment method currency, currency conversion rates, charges, or fees may apply. Your bank, card issuer, payment provider, or mobile-money provider may apply additional charges outside our control.
8.5. Some payment services may be subject to the separate terms and privacy policies of the relevant payment provider.
8.6. For payment disputes, refund requests, or transaction issues, please contact us through our contact page .
Where TourVigator offers gift cards or platform credits, their use will be subject to the specific terms displayed at the time of purchase or issue.
Gift cards and credits may have expiry dates, restrictions, non-refundable conditions, or limitations on eligible Activities. Unless required by applicable law, no cash equivalent will be paid.
We may cancel or restrict gift cards or credits where there are reasonable grounds to suspect fraud, misuse, unlawful activity, or unauthorised use.
10.1. Cancellation, amendment, refund, and no-show conditions are determined primarily by the conditions displayed on the relevant Activity listing and any Supplier-specific terms provided before booking.
10.2. You are responsible for reviewing the cancellation and amendment conditions before completing your booking.
10.3. Unless different conditions are clearly displayed for the Activity, the following default cancellation policy may apply:
(a) Cancellations made more than 24 hours before the scheduled Activity start time: a full refund of the Booking Price may be available.
(b) Cancellations made within 24 hours of the scheduled Activity start time, or failure to attend, may be non-refundable.
These default conditions are subject to the specific Activity terms and any mandatory rights available to you under applicable law.
10.4. Cancellation or amendment requests should be submitted through the Platform or our contact page .
10.5. If a Supplier cancels an Activity and you are entitled to a refund, we will assist with processing the applicable refund in accordance with the booking conditions and applicable law.
10.6. Refunds are normally returned through the original payment method. Processing times may depend on the payment provider, bank, card network, or other payment service involved.
11.1. Reviews, photographs, comments, ratings, and other material posted by Users ("User Content") represent the views and experiences of the individual User who submitted them.
11.2. You are responsible for User Content that you submit. Content must be truthful, based on your genuine experience, and must not be unlawful, fraudulent, defamatory, misleading, abusive, discriminatory, or infringe the rights of another person or organisation.
11.3. By submitting User Content, you grant TourVigator a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, translate, publish, display, and distribute that content for operating, improving, promoting, and marketing the Platform, subject to applicable law.
11.4. You retain ownership of your User Content, subject to the licence granted above.
11.5. We may remove, restrict, or decline to publish User Content where we reasonably believe it violates these Terms, applicable law, or our content standards.
TourVigator processes personal data in accordance with applicable data protection and privacy laws.
Because the Platform is available internationally, personal data may be processed, stored, accessed, or transferred across international borders. This may occur because Users and Suppliers are located in different countries and because we use third-party technology, hosting, payment, communications, security, analytics, and other service providers.
Where applicable, we will take reasonable steps to address international data-transfer and privacy requirements.
Full information about how we collect, use, share, store, and protect personal data, together with applicable User rights, is provided in our Privacy Policy .
All Platform content and technology, including the TourVigator name, logo, design, software, text, graphics, interfaces, databases, and other materials, are owned by or licensed to TourVigator or their respective rights holders.
You may not reproduce, modify, distribute, publicly display, commercially exploit, reverse-engineer, or otherwise use Platform content except as permitted by these Terms, applicable law, or our prior written permission.
Supplier and User Content remains subject to the rights of the relevant Supplier or User and any licences granted to TourVigator.
You may not transfer, assign, or sub-license your rights or obligations under these Terms to another person without our prior written consent, except where such restriction is not permitted by applicable law.
We may transfer or assign our rights and obligations under these Terms to an affiliate, successor entity, purchaser, or other entity as part of a restructuring, merger, acquisition, financing, or business transfer, provided that applicable legal requirements are respected.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or removed where modification is not possible.
The remaining provisions shall continue in full force and effect to the extent permitted by applicable law.
You may request closure of your account at any time through our contact page .
We may suspend, restrict, or terminate access to an account or the Platform where reasonably necessary for security, fraud prevention, legal compliance, serious breach of these Terms, misuse, or other legitimate operational reasons.
Termination of an account does not automatically cancel or remove obligations relating to bookings already confirmed.
17.1. Subject to mandatory rights under applicable law, these Terms are governed by and construed in accordance with the applicable laws of the United Republic of Tanzania.
17.2. Subject to mandatory consumer protection or other applicable legal requirements, disputes arising from these Terms or your use of the Platform shall be submitted to the competent courts of Zanzibar, Tanzania.
17.3. Nothing in this section prevents a consumer from exercising mandatory rights to bring proceedings in their country of residence where such rights cannot legally be excluded.
17.4. Before commencing formal proceedings, we encourage you to contact us through our contact page so that we can attempt to resolve the matter informally.
17.5. Nothing in these Terms is intended to exclude or limit any mandatory statutory rights or remedies that cannot lawfully be excluded or limited.
18.1. Booking relationship. When you complete a booking through the Platform, the relevant Supplier is responsible for providing the booked Activity in accordance with the applicable Activity description, booking conditions, and applicable law.
18.2. Supplier independence. Suppliers are independent businesses and are not employees, partners, joint venturers, or general representatives of TourVigator unless expressly stated otherwise.
18.3. Supplier compliance. Suppliers are responsible for obtaining and maintaining all licences, permits, registrations, approvals, insurance, qualifications, certifications, and other authorisations required to operate and provide their Activities in the jurisdictions where they operate.
18.4. Supplier taxes. Suppliers are responsible for their own taxes, VAT, tourism levies, business taxes, withholding obligations, reporting requirements, and other governmental charges applicable to their business and Activities in their respective jurisdictions.
18.5. Supplier information. Suppliers are responsible for ensuring that Activity descriptions, prices, availability, meeting points, schedules, inclusions, exclusions, restrictions, safety information, and other information they provide are accurate and kept up to date.
18.6. Safety and delivery. Suppliers are responsible for delivering Activities safely and in accordance with applicable laws, regulations, professional standards, and the conditions communicated to customers.
18.7. Customer requirements. You are responsible for reviewing and complying with any participation requirements, age restrictions, physical requirements, dress requirements, required documents, meeting instructions, and other conditions disclosed for your Activity.
18.8. Travel documents. You are responsible for ensuring that you hold any passport, visa, permit, vaccination documentation, insurance, or other travel documentation required for your journey and Activity.
18.9. Supplier cancellation. A Supplier may cancel or modify an Activity where permitted by the applicable booking conditions, including where reasonably necessary because of weather, safety concerns, natural events, government restrictions, operational circumstances, or other events beyond the Supplier's reasonable control.
18.10. Where a Supplier cancellation gives you a right to a refund under the applicable booking conditions or law, TourVigator will assist in facilitating the applicable refund.
19.1. We aim to maintain the availability, security, and accuracy of the Platform, but we do not guarantee that the Platform will always be available, uninterrupted, error-free, or free from harmful components.
19.2. We are not responsible for interruptions caused by circumstances outside our reasonable control, including internet failures, telecommunications failures, payment-service interruptions, hosting failures, cyber incidents, natural events, government restrictions, or other force majeure events.
19.3. Because Activities are supplied by independent Suppliers, TourVigator does not guarantee the quality, safety, legality, suitability, availability, or accuracy of every Activity or Supplier.
19.4. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from fraud or other matters for which exclusion is prohibited by applicable law.
20.1. We may use affiliates, contractors, agents, technology providers, payment processors, hosting providers, communications providers, and other third-party service providers to operate and support the Platform.
20.2. We may update these Terms from time to time for legal, operational, security, technological, or commercial reasons.
20.3. Where changes are material and applicable law requires notice, we will provide reasonable notice through email, the Platform, or another appropriate communication method.
20.4. Any formal notice under these Terms should be submitted in writing, including through the contact details provided in our Legal Notice .
20.5. These Terms, together with the Privacy Policy, applicable Activity terms, booking conditions, and other terms expressly incorporated into the booking process, constitute the agreement governing your use of the Platform and your bookings made through it, subject to applicable law.
Applicable to Users accessing or using the Platform from outside Tanzania.
A1. International availability. TourVigator is registered and based in Zanzibar, Tanzania, but the Platform is available internationally and may connect Users with Suppliers operating in many different countries and destinations.
A2. Local laws. Users are responsible for complying with laws applicable to their use of the Platform, travel, destination, and participation in Activities. Suppliers are responsible for laws applicable to their businesses and Activities in the jurisdictions in which they operate.
A3. Consumer protection. If you are a consumer, you may have statutory rights under the laws of your country of residence. Nothing in these Terms is intended to remove rights that cannot lawfully be removed.
A4. Data transfers. Because Users, Suppliers, and service providers may be located in different countries, personal information may be processed across national borders. Details are provided in our Privacy Policy .
A5. Currency and payment. International bookings may involve currency conversion and payment processing by third-party financial institutions or payment providers. Additional charges may be imposed by your bank, card issuer, mobile-money provider, or other payment service.
A6. Activity-specific requirements. Activities may be subject to local safety rules, age restrictions, health requirements, permits, weather conditions, dress codes, identification requirements, or other local conditions. These requirements may differ between countries and Activities.
A7. Dispute resolution. We encourage Users to contact TourVigator first so that we can attempt to resolve disputes efficiently. Subject to mandatory local rights, the governing law and jurisdiction are described in Section 17.
A8. Limitation of liability. To the maximum extent permitted by applicable law, any limitation of liability contained in these Terms shall apply only to the extent that such limitation is lawful in the relevant jurisdiction.
